These Terms of Service (“Terms”) govern your access to and use of the Pointify platform, including our mobile application and website. Please read them carefully. By creating an account or using Pointify you agree to be bound by these Terms. If you do not agree, do not use the platform.

About Pointify
Pointify is a loyalty-rewards platform that connects consumers (“Customers”) with businesses (“Partners”). Customers earn points when they engage with participating Partner businesses; Partners use the platform to configure rewards programmes and manage customer relationships.
The platform is operated by Pointify (pointify.org), with its registered address in Kraków, Poland (“we”, “us”, “our”, “Pointify”). Our contact email is support@pointify.org.
Definitions

Eligibility & Account Registration
Age requirement. You must be at least 16 years old to register as a Customer. Partners must be legally authorised to act on behalf of a business entity.
Accurate information. When creating an account you must provide accurate, current, and complete information including your name, email address, and country. You may also provide a phone number for account security and notifications. You are responsible for keeping this information up to date.
One account per person. Each individual Customer may hold only one Customer account. Creating multiple accounts to accumulate points artificially is a breach of these Terms.
Password security. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@pointify.org if you suspect any unauthorised access.
Email verification. We require email verification before full access is granted. Accounts with unverified email addresses may have restricted functionality.
Consent and contract. Accepting these Terms is a condition of using the service and is based on contract performance (Art. 6(1)(b) GDPR). Marketing communications require separate, optional consent and are not a condition of using Pointify — accepting these Terms does not constitute consent to marketing. You may manage your marketing preferences at any time in the app’s Consent Management settings or by emailing support@pointify.org. Two Types of Users: Customers & Partners
Pointify serves two distinct user types, each with different rights and responsibilities:
CUSTOMER Individual consumers who use the Platform to:
- Discover participating Partner businesses.
- Earn Points through qualifying interactions with Partners.
- Redeem accumulated Points for Benefits offered by Partners.
- View their points balance, transaction history, and account details.
- Receive notifications about new Benefits (if notifications are enabled).
PARTNER Business operators who use the Platform to:
- Create and manage a business profile (name, description, logo, address, contact details).
- Define Benefits and the Points required to redeem them.
- Issue Points to Customers via QR codes or other Platform mechanisms.
- View Customer engagement analytics.
- Receive notifications about platform updates (if notifications are enabled).
The Points System
5.1 Nature of Points. Points are digital reward units that exist only within the Pointify Platform. They:
- Have a defined earning rate: every 1 unit of currency spent at a Partner (regardless of whether that currency is USD, PLN, EUR, or another currency) earns 4 Points.
- Cannot be converted back into cash or any currency under any circumstances.
- Can only be redeemed for Benefits (goods or services) offered by Partners within the Platform.
- Cannot be transferred between Customer accounts.
- Cannot be purchased directly by Customers with money.
- Are not redeemable outside of the Pointify Platform.
Important: Although Points are awarded at a rate linked to currency spent, they do not constitute electronic money and cannot be cashed out. Pointify operates a closed-loop loyalty programme and is not a payment service provider, e-money issuer, or financial institution. Pointify does not process, hold, or transfer any payments between Customers and Partners. All monetary transactions (e.g. purchasing goods) occur directly between the Customer and the Partner through the Partner’s own payment methods. No fees are charged to Customers for earning or redeeming Points.
5.2 Earning Points. Customers earn Points when a Partner scans their QR code in the Pointify app after a qualifying purchase. The scan flow has two steps: (i) the Partner scans the Customer’s QR code, at which point the Partner sees the Customer’s name, email address, current Points balance with that Partner, and any active Benefits the Customer has redeemed at that Partner and not yet used; (ii) the Partner enters the transaction amount and completes the scan, and Pointify awards 4 Points per 1 unit of the applicable currency, regardless of which Benefits (if any) are being used in the same transaction. The QR code displayed in the app expires after 2 minutes; if it expires before the Partner scans it, the Customer may generate a new code at no cost. Pointify does not verify, process, or take responsibility for the underlying commercial transaction between the Customer and the Partner.
5.3 Redeeming Points. Customers may redeem their accumulated Points for Benefits listed by Partners. Once Points are redeemed, they are deducted from the Customer’s balance and cannot be refunded unless the redemption was the result of a Platform error. A redeemed Benefit is valid for 24 hours from the time of redemption. The Customer presents the Benefit by displaying their in-app QR code at the Partner; the Benefit is automatically marked as used when the Partner completes a scan of that code. All Benefits the Customer holds in active state at that Partner are consumed together by a single completed scan. Redeeming a Benefit does not change the rate at which Points are earned in the same transaction — Points are always calculated against the full transaction amount entered by the Partner. If the Benefit is not presented to the Partner within the 24-hour window, it will expire automatically and the Points already deducted will not be reinstated.
5.4 Points Expiry. Points may expire if an account is inactive for an extended period (defined as no login or transaction for 24 consecutive months) or if the Partner programme associated with those Points is terminated. We will endeavour to notify Customers of impending expiry where reasonably practicable.
5.5 Points Integrity. We reserve the right to adjust, suspend, or void Points in the event of:
- Suspected fraud, abuse, or manipulation of the Points system.
- Technical errors that resulted in incorrect Points being credited.
- Violations of these Terms.
- Termination of a Partner programme.
5.6 No Guarantees on Benefits. The availability, value, and continuity of Benefits are set by Partners and may change. Pointify does not guarantee that any particular Benefit will remain available for redemption.
Partner Obligations
6.1 Accurate business information. Partners must provide truthful and complete information about their business, including legal business name, address, business category, and contact details. Misrepresentation is grounds for immediate account suspension.
6.2 Logo and description. Partners are responsible for all Content they upload, including logos and descriptions. Content must not infringe third-party intellectual property rights or contain misleading, offensive, or illegal material.
6.3 Benefit fulfilment. Partners are solely responsible for honouring Benefits they advertise on the Platform. Customers who have legitimately redeemed Points for a Benefit are entitled to receive it. Pointify is not liable for a Partner’s failure to fulfil a Benefit.
6.4 QR code security. Partners must take reasonable steps to prevent unauthorised use of their QR codes or other Points-issuance mechanisms.
6.5 Compliance with law. Partners must comply with all applicable laws when operating their loyalty programme, including consumer protection laws, advertising standards, and data protection regulations (GDPR where applicable).
6.6 No cash-back schemes. Partners may not use the Platform to offer cash-back arrangements or to circumvent financial regulations.
6.7 Programme suspension. If a Partner suspends or terminates their programme, they must notify Pointify with reasonable advance notice (minimum 30 days) so that affected Customers can be informed.
6.8 Confidentiality of Customer information. When a Partner scans a Customer’s QR code, the Partner sees the Customer’s name, email address, current Points balance with that Partner, and any active Benefits awaiting fulfilment. Partners must treat this information as confidential, use it solely to identify the Customer and honour Benefits, and store and process it in accordance with applicable data protection law (including GDPR where applicable). Partners act as independent data controllers for that information.
6.9 Active Benefits and Benefit edits. While a Customer holds an active redemption against one of a Partner’s Benefits, the Partner cannot edit or delete that Benefit. Partners should account for this when planning programme changes.
Customer Obligations
7.1 Honest use. Customers must use the Platform honestly and in good faith. Attempts to earn Points through fraudulent means (e.g. faking visits, abusing QR codes) are strictly prohibited.
7.2 Personal use only. A Customer’s account is for their personal use. Sharing accounts or Points with others to circumvent programme rules is not permitted.
7.3 No automated access. Customers may not use bots, scripts, or automated tools to interact with the Platform.
7.4 Notification settings. Customers control their own notification preferences within the app and may update them at any time.
Prohibited Conduct
The following are strictly prohibited for all users (Customers and Partners):
- Creating fake accounts or impersonating another person or business.
- Attempting to gain unauthorised access to another user’s account or to the Platform’s infrastructure.
- Reverse-engineering, decompiling, or attempting to extract source code from the Platform.
- Uploading viruses, malware, or any code intended to disrupt the Platform.
- Using the Platform to engage in spamming, phishing, or unsolicited communications.
- Scraping, crawling, or harvesting data from the Platform without written permission.
- Circumventing rate limits, security measures, or access controls.
- Using the Platform for any unlawful purpose or in violation of applicable laws.
- Attempting to manipulate Points balances through technical exploits.
- Reselling, brokering, or commercially exploiting Points outside the Platform.
Violation of these prohibitions may result in immediate account suspension, Points forfeiture, and legal action where appropriate.
Intellectual Property
9.1 Our IP. The Pointify name, logo, platform software, design, and all content created by us are protected by copyright, trademark, and other intellectual property laws. You may not use our brand assets without our prior written consent.
9.2 Partner Content licence. By uploading logos, descriptions, or other Content to the Platform, Partners grant Pointify a non-exclusive, worldwide, royalty-free licence to display and use that Content within the Platform for the purpose of operating the service (e.g. showing the Partner’s profile to Customers). This licence ends when the Content is removed or the Partner account is deleted.
9.3 Feedback. If you submit ideas, suggestions, or feedback about the Platform, you grant us permission to use that feedback without restriction or compensation.
Platform Availability & Changes
10.1 No uptime guarantee. We aim to keep the Platform available at all times but do not guarantee uninterrupted access. Scheduled maintenance, updates, or unforeseen outages may cause temporary unavailability. We will endeavour to provide advance notice of planned downtime.
10.2 Feature changes. We may modify, add, or remove features at any time. We will provide reasonable notice of significant changes that materially affect your use of the Platform.
10.3 Infrastructure. The Platform is hosted on Amazon Web Services (AWS). In the event of an AWS outage, we cannot guarantee service continuity but will restore access as quickly as possible.
Limitation of Liability
11.1 General exclusions. To the maximum extent permitted by applicable law, Pointify shall not be liable for:
- Loss of Points due to account suspension resulting from a breach of these Terms.
- A Partner’s failure to honour a Benefit.
- Loss of data, revenue, or profits arising from Platform unavailability.
- Indirect, incidental, special, or consequential damages arising from your use of the Platform.
- Any loss caused by third-party services integrated with or linked from the Platform.
11.2 Consumer rights. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory rights you have as a consumer that cannot be excluded by contract under applicable law (including EU consumer protection legislation and UK consumer rights law).
11.3 Aggregate liability cap. Where permitted by law, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed EUR 100 (one hundred euros).
Indemnification
You agree to indemnify, defend, and hold harmless Pointify and its operators, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform in breach of these Terms.
- Content you upload to the Platform that infringes third-party rights.
- Your violation of any applicable law or regulation.
- A Partner’s failure to fulfil a Benefit promised through the Platform.
Termination
13.1 Termination by you. You may close your account at any time via the “Delete Account” option in the app settings, or by contacting us at support@pointify.org. Upon deletion of a Customer account, any unused Points will be permanently forfeited. Partner accounts remain subject to the 30-day programme-suspension notice obligation in section 6.7.
13.2 Termination by us. We reserve the right to suspend or permanently terminate any account, with or without notice, if we reasonably believe:
- You have violated these Terms.
- Your account poses a security or fraud risk.
- Continued access would be unlawful.
- The account has been inactive for more than 36 consecutive months.
13.3 Effect of termination. Upon termination, your right to access the Platform ceases immediately. Sections that by their nature should survive (including sections 8, 9, 11, 12, 14) will remain in effect after termination.
13.4 Data after termination. How we handle your data after account deletion is described in our Privacy Policy.
Governing Law & Dispute Resolution
14.1 Governing law. These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-laws principles.
14.2 EU consumers. If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of the EU member state in which you reside. Those mandatory protections cannot be excluded by the choice of Polish law.
14.3 UK consumers. If you are a consumer resident in the United Kingdom, UK consumer protection law (including the Consumer Rights Act 2015) applies alongside these Terms. The choice of Polish law does not deprive you of the protection of mandatory UK rules.
14.4 Dispute resolution. We encourage you to contact us first at support@pointify.org to resolve any dispute informally. If a dispute cannot be resolved within 30 days of written notice, either party may submit the dispute to the competent courts in Poland. EU consumers may alternatively use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
14.5 No class actions. To the extent permitted by applicable law, all disputes must be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
International Users
Pointify is operated from Poland. Customers (individuals) may register and use the Platform from any country we support. Partners (businesses) are currently accepted from the following countries only:
European Union: Austria, Belgium, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.
Other countries: Armenia, Azerbaijan, Belarus, Georgia, Turkey, Ukraine, United Kingdom, United States.
By using the Platform from outside Poland, you acknowledge that your information will be transferred to and processed in Poland and on AWS infrastructure (which may involve data centres in the EU, UK, or US). Details of the safeguards in place for each country are set out in our Privacy Policy.
You are responsible for ensuring that your use of the Platform complies with local laws in your country of residence. If any provision of these Terms conflicts with a mandatory rule of law in your country, that mandatory rule will prevail to the minimum extent required.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the “Last updated” date at the top of this page.
- Notify registered users via in-app notification or email (if notifications are enabled).
- For significant changes, provide at least 30 days’ notice before the new Terms take effect.
Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Platform and may close your account.
